Apple Denied Injunction Against Samsung In U.S.

Apple had sought an injunction against Samsung Galaxy Tabs and Galaxy S series smartphones in the United States. However, they were unable to convince U.S. District Court Judge, Lucy Koh in San Jose California that such an injunction was warranted.

This lawsuit goes back to April when Apple accused Samsung of “slavishly” copying their iPhone and iPad devices.

On Friday Koh denied Apple’s request for an injunction against 3 Samsung Galaxy S smartphones and Samsung’s Galaxy Tab 10.1 In her decision Koh wrote:

“It is not clear that an injunction on Samsung’s accused devices would prevent Apple from being irreparably harmed,”

Samsung spokesman Jason Kim told Reuters in an email:

“This ruling confirms our long-held view that Apple’s arguments lack merit,”

Apple and Samsung are engaged in 20 legal battles over patents in 10 different countries. Apple was successful in both Germany and Australia with injunctions to stop the sale of Galaxy Tab 10.1′s until the patent legal process has finished.

In Germany, Samsung had to go as far as taking down displays of their Samsung Galaxy Tab 7.7 at the IFA trade show at Messe Berlin in September. In Australia Apple had been granted an injunction which Samsung fought and won on appeal, however the injunction was reinstated.
